Welcome to Indulge In A Scent. These Terms of Service (“Terms”) govern your use of our website located at www.indulgeinascent.com (the “Site”) and the purchase of our products and services. By accessing our Site or purchasing our mood-boosting candles, calming room sprays, or nourishing body products, you agree to be bound by these Terms.

Please read them carefully. If you do not agree to these Terms, you may not access the Site or use our services.

1. Introduction & Acceptance of Terms

Indulge In A Scent provides home fragrance and self-care products designed to help you reset and recharge. These Terms apply to all users of the Site, including without limitation users who are browsers, customers, and merchants. By accessing or using the Site, creating an account (if available), placing an order, or otherwise interacting with us, you agree to these Terms and our policies referenced in these Terms.

We may update these Terms from time to time by posting an updated version on the Site and updating the “Last Updated” date above. Your continued use of the Site after changes are posted means you accept the updated Terms.

2. Store Terms (Eligibility, Age Requirements)

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and that you have the legal capacity to enter into a binding contract. If you are not the age of majority, you may use the Site only with involvement and consent of a parent or legal guardian.

You may not use the Site or our products for any illegal or unauthorized purpose, and you agree to comply with all applicable laws, rules, and regulations when using the Site and purchasing/using our products.

3. Product Accuracy (Scents, Colors, Descriptions)

We specialize in hand-poured candles, room sprays, and skincare items. We work hard to describe our products as accurately as possible; however:

Scent Variability: Fragrance notes and scent throw can be subjective and may vary based on individual perception, room size, airflow, and use conditions.
Color/Appearance: Product color, finish, labeling, and appearance may vary slightly due to small-batch production and screen/display differences. We cannot guarantee that your device will display colors or textures accurately.
Product Information: We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time (including after you have submitted an order).

4. Pricing and Payment

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time.

By placing an order, you agree to provide current, complete, and accurate purchase and account information (if requested), including a valid payment method and shipping information. You authorize us (and our payment processors) to charge your selected payment method for your order total, including applicable taxes and shipping/handling fees.

We are not responsible for additional fees that may be imposed by your bank or payment provider (such as overdraft fees, currency conversion fees, or other processing fees).

5. Intellectual Property Rights (Brand, Content, Fragrance Names)

The Site and its original content, features, and functionality—including the brand name “Indulge In A Scent,” product names, fragrance names/collections, logos, graphics, text, photographs, designs, and the tagline “Fragrance That Feels Like Self-Care”—are owned by or licensed to Indulge In A Scent and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.

Except as expressly permitted in writing by Indulge In A Scent, you may not copy, reproduce, distribute, create derivative works from, publicly display, publicly perform, or otherwise exploit any portion of the Site or our branding/content.

6. User Content & Feedback

If you submit, upload, or otherwise provide content to us or on the Site (such as reviews, photos, videos, comments, testimonials, suggestions, or other feedback) (“User Content”), you represent that:

you own or have the necessary rights to submit the User Content, and
the User Content does not violate any law or the rights of any third party.

You grant Indulge In A Scent a non-exclusive, worldwide, royalty-free, fully paid, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, publicly display, and otherwise use your User Content in any media for our business purposes (including marketing and promotional purposes), without compensation to you, unless prohibited by law.

You agree not to submit User Content that is unlawful, defamatory, obscene, harassing, threatening, invasive of privacy, infringing, misleading, or otherwise objectionable.

7. Prohibited Uses (No Scraping, No Reselling Without Permission)

You agree not to (and not to attempt to):

use the Site for any unlawful purpose or in violation of these Terms;
scrape, crawl, spider, harvest, or collect data from the Site by automated means (including using bots, scripts, or similar tools) without our express written permission;
interfere with or disrupt the Site, servers, or networks connected to the Site, or bypass any measures we may use to prevent or restrict access to the Site;
use the Site or our content/branding to create a competing product or service;
reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site, access to the Site, or any products for any commercial purpose without express written permission; or
purchase our products for the primary purpose of resale, wholesale, distribution, or commercial exploitation unless we have expressly agreed in writing (for example, through an authorized wholesale program).

We reserve the right to refuse service, cancel orders, limit quantities, suspend accounts (if applicable), or restrict access to the Site if we believe, in our sole discretion, that your conduct violates these Terms or is harmful to our business.

8. Workshops (Candle Making, Wax Products, and Fragrance-Related Sessions)

This Section applies to any in-person or virtual class, workshop, event, lesson, demonstration, or session we offer (each, a “Workshop”), including candle-making, wax melts/wax product activities, and fragrance-related sessions (such as fragrance blending or use of fragrance oils).

Registration; Attendance; Participation.

Reservation/Payment: Workshop spots may be limited and may require advance registration and payment. Your registration is not confirmed until payment is received (unless we state otherwise in writing).
Arrival & Access: For in-person Workshops, you are responsible for arriving on time. Late arrival may result in missing instructions, reduced participation time, or denial of entry if it would disrupt the Workshop.
Virtual Workshops: For virtual Workshops, you are responsible for having a working internet connection and compatible device. We are not responsible for interruptions caused by your equipment, software, or connectivity.
Conduct: You agree to follow instructor directions and behave respectfully. We may refuse participation or remove you from a Workshop (in-person or virtual) for disruptive, unsafe, or inappropriate behavior, without refund where permitted by law.

Safety Protocols (Hot Wax, Heat Sources, Tools, and Fragrances).

Hot Wax/Heat Risks: Workshop activities may involve heated wax, hot vessels, open flames or heat sources (as applicable), sharp tools, and other materials that can cause burns, cuts, irritation, or property damage if used improperly.
Fragrance Exposure: Workshop activities may involve fragrance oils or other scented materials that may cause allergic reactions, headaches, nausea, skin or eye irritation, or respiratory irritation for some individuals. You are responsible for assessing your own sensitivities/allergies and participating accordingly.
Protective Measures: You agree to follow all posted and verbal safety rules, including (where applicable) use of protective gear, safe handling and storage of fragrance oils, safe handling of hot wax and heated containers, and keeping materials away from children, pets, and flammable items.
Health Conditions: You are responsible for consulting a medical professional if you have concerns about participating due to asthma, allergies, pregnancy, or other health conditions. Do not participate if you are under the influence of alcohol, cannabis, or any substance that could impair judgment or coordination.

Assumption of Risk; Workshop Liability Waiver (In-Person and Virtual).
To the fullest extent permitted by law, you knowingly and voluntarily assume all risks associated with participation in any Workshop, whether in-person or virtual, including risks arising from: (a) handling hot wax, heated containers, or heat sources; (b) use of tools and equipment; (c) exposure to fragrance oils or scented materials; (d) spills, splashes, burns, cuts, allergic reactions, or respiratory irritation; (e) damage to your clothing, home, workspace, furnishings, or other property; and (f) for in-person Workshops, risks associated with travel to/from the venue and being in a group environment.

To the fullest extent permitted by law, you (on behalf of yourself and your heirs, executors, and assigns) release and waive any and all claims against Indulge In A Scent and our owners, directors, officers, employees, contractors, agents, suppliers, and affiliates for injuries, losses, damages, or liabilities arising out of or related to your participation in a Workshop, except to the extent caused by our gross negligence or willful misconduct where such limitation is not permitted by law.

Virtual Workshop Workspace Responsibility.
For virtual Workshops, you are solely responsible for setting up and maintaining a safe workspace (including ventilation, heat-safe surfaces, and safe placement/operation of any heat source you choose to use), and for following all local laws and manufacturer instructions for any equipment or materials used. You acknowledge that we do not control your environment and cannot guarantee your safety during a virtual Workshop.

9. Limitation of Liability & Indemnification

Limitation of Liability. To the fullest extent permitted by law, in no case shall Indulge In A Scent, our owners, directors, officers, employees, contractors, agents, suppliers, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, special, consequential, exemplary, or punitive damages of any kind arising from or related to your use of the Site, your inability to use the Site, or your purchase or use of any products, including, without limitation, damages for lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the Site, these Terms, or any products purchased from us will not exceed the amount you paid to us for the applicable product(s) giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification. You agree to indemnify, defend, and hold harmless Indulge In A Scent and our owners, directors, officers, employees, contractors, agents, suppliers, and affiliates from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your breach of these Terms; (c) your violation of any law or third-party rights; or (d) your User Content.

10. Governing Law (New York State)

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products purchased from Indulge In A Scent shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
